If you were arrested in the northern part of the county your first court date will be located at 29582 U.S. 19 North in Clearwater, Florida. Prosecuting attorneys will seek to obtain a conviction for DUI charges by proving that you were under the influence of alcohol or drugs. To prove this, the officer’s observations, field sobriety test results and breath or blood test results will be used as evidence against the driver. The prosecution must prove that you had a blood alcohol concentration above the legal limit or that your normal abilities were impaired due to alcohol or a controlled substance of any kind. Although you may have submitted to chemical tests and field sobriety tests and may have “failed” in the eyes of the officer, there are numerous ways that a DUI lawyer can still protect your rights and help you avoid a conviction. All areas of the initial police stop, arrest and testing can be carefully reviewed and challenged. With the proper knowledge and resources, the right lawyer can help you avoid a conviction.
Once you have been released from jail you need to act quickly. If you blew over the legal limit of a .08 or refused a breath test your license is automatically suspended with the Department of Highway Safety and Motor Vehicles. You must challenge that suspension within the first 10 days. You can drive on your DUI citation for those first 10 days as long as your license was valid at the time of the DUI arrest. We would file the necessary paperwork to challenge your license suspension at the Bureau of Administrative review located in Clearwater, Florida.
